This Privacy Policy explains how TuxMat Inc. (“TuxMat,” “we,” “us”) collects, uses, discloses, and protects personal information when you visit or make a purchase from our websites (including tuxmat.ca, tuxmat.com, and tuxmat.de) and related online services (collectively, the “Site”), interact with us, or contact customer support. This Privacy Policy is supplemented by region-specific appendices.

What Do We Do With Your Information?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you provide, such as your name, email address, phone number, billing and shipping address, and order details.
When you browse our store, we automatically receive certain device and usage information, such as your internet protocol (IP) address and information about your browser and operating system, to help us operate the Site, keep it secure, and improve your experience.
We use this information to process orders and payments, deliver products, provide customer support (including returns and warranty requests), and maintain our business records. Where permitted, we may also use your information to send marketing communications about our store, new products, and other updates. You can unsubscribe from marketing emails at any time using the link in the email or by contacting us.

Disclosure
We may share personal information with third parties that help us provide the Site and our services, such as our e-commerce platform provider, payment processors, shipping carriers, IT and security vendors, analytics providers, and advertising partners.
We may also share information with our financial, insurance, legal, accounting, or other professional advisors. We may disclose your personal information if we are required by law to do so, to respond to lawful requests, to protect our rights and the rights of others, or if you violate our Terms of Service.
Additionally, we work with analytics and advertising partners that use cookies and similar technologies to help us market our products and measure advertising effectiveness.
Shopify & Payment
Our store is hosted on Shopify, which provides the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s secure data storage, databases, and application on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, Shopify and our payment processors handle your information in accordance with the Payment Card Industry Data Security Standard (PCI-DSS). Purchase transaction information is retained only as long as necessary to complete the transaction and meet applicable legal and operational requirements.
Data Retention
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, including to comply with applicable legal, accounting, tax, reporting, and warranty obligations, and for other legitimate business purposes.
If you have opted in to our newsletter, we retain your email address until you withdraw your consent. Once personal information is no longer required, it is either securely destroyed or anonymized.
Third-Party Services
In general, third-party providers used by us will collect, use, and disclose your information only to the extent necessary to perform the services they provide to us.
Some service providers may be located in a different jurisdiction than you or us, including outside of Canada, and your information may be transferred to or processed in those jurisdictions. When this happens, your information may be subject to the laws of the jurisdiction where it is processed.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. We recommend that you review the privacy policies of any third-party sites you visit.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
Security
To protect your personal information, we take reasonable precautions and follow industry best practices to reduce the risk of loss, misuse, unauthorized access, disclosure, alteration, or destruction.

We reserve the right to modify this Privacy Policy at any time. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes, we will update the “Last updated” date at the top of this Policy.

Appendix A - Canada
This Appendix applies to individuals located in Canada. We handle personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy legislation.
You may request access to or the correction of your personal information, subject to certain legal exceptions, by contacting us at privacy@tuxmat.ca. You may also withdraw your consent for marketing communications at any time by using the unsubscribe link provided in our messages or by contacting our Privacy Officer directly.
In instances where we use service providers located outside of Canada, such as in the United States, your personal information may be processed in those jurisdictions and may be subject to their local laws. We take reasonable steps to ensure that your personal information is protected and that all third-party service providers use it only for authorized purposes.
Appendix B - United States
This Appendix applies to individuals residing in the United States and provides additional disclosures required under applicable U.S. state privacy laws, including California. Section 1 of this Appendix also serves as the Notice at Collection for California residents for purposes of the California Consumer Privacy Act (“CCPA”).
Notice at Collection (California)
When you interact with the Site, we may collect personal information, including identifiers (such as your name, email address, IP address, and other online identifiers), customer records information (such as your billing and shipping address), commercial information (such as products purchased or considered), and internet or other electronic network activity information (such as browsing activity and interactions with the Site).
We use this information to operate the Site, process transactions, provide customer support, maintain security, prevent fraud, conduct analytics, and support marketing and advertising activities. We retain personal information for as long as reasonably necessary for the purposes described in this Policy, based on the nature of the information, our legal obligations, and our operational needs.
Disclosure of Personal Information; “Sale” and “Sharing”
We may disclose personal information to service providers and contractors for business purposes such as order fulfillment, payment processing, shipping, customer support, fraud prevention, security, analytics, and site operations.
We do not use or disclose sensitive personal information except as permitted by applicable law. To opt out of the sale or sharing of personal information, you may use our Do Not Sell or Share My Personal Information or any other privacy choices tool we make available on the Site.
Where required by law, we also recognize browser-based opt-out preference signals, such as the Global Privacy Control (GPC), for the browser or device transmitting the signal. If we decline to take action on your request, you may appeal our decision by contacting us at privacy@tuxmat.ca.
Non-Discrimination
We will not discriminate against you for exercising any privacy rights available to you under applicable law.
Appendix C - EEA + UK + Switzerland
This Appendix applies to individuals in the European Economic Area (EEA), the United Kingdom, and Switzerland. For the purposes of applicable data protection law, TuxMat Inc. is the controller of your personal data.
We process your data to perform contracts (such as order fulfillment), to comply with legal obligations, and for our legitimate interests, which include operating the Site, preventing fraud, and ensuring system security. Where required by law, we rely on your explicit consent for marketing communications and the use of non-essential cookies.
We share personal data with specific categories of recipients, including our e-commerce platform provider (Shopify), payment processors, and logistics partners. Some of these recipients may process data outside the EEA, the UK, or Switzerland, including in Canada and the United States. Where required, we utilize appropriate safeguards, such as Standard Contractual Clauses, to ensure the continued protection of your data.
We retain personal data only for as long as necessary to fulfill orders, maintain accounting and tax records, and handle potential disputes.
You have the right to request access to, correction of, or deletion of your personal data, as well as the right to object to or restrict processing, request data portability, and withdraw consent where applicable. You also have the right to lodge a complaint with a supervisory authority.
